The more rigorous Doctor of Theology degree is superior to the Divinity degree, in that it's more academically challenging, and involves a greater degree of historical research, for example. You can't at a non-accredited school, and there are a Bunch of those out there. But you can at a properly accredited college. The Supreme Court, including the beloved far right judges, decided that the states had a right to refuse to fund religious studies that were not academic. The ACLU's position was that individual states be able to make that decision and that the federal government had no business in the affair. They did not oppose a state deciding to fund religious studies.
